Agent supervision under REAA 2008
Every salesperson doing agency work in New Zealand must be properly supervised and managed by a licensed agent or branch manager. Ownly provides that licensed branch manager supervision so experienced salespeople can run their own brand without holding an agent's licence.
What the Real Estate Agents Act 2008 requires
Section 50 of REAA 2008 requires a salesperson, in carrying out any agency work, to be properly supervised and managed by an agent or a branch manager. Properly supervised means enough direction and control to ensure the work is performed competently and complies with the Act. The duty applies regardless of experience, GCI or whether you are an employee or an independent contractor.
Do you need an agent's licence to go independent?
No. A salesperson licence is enough if you work inside a licensed agency structure with proper supervision. Ownly is that structure: licensed branch manager supervision, AML, agreements and reporting, so the legal duty is met while you list and sell.
How Ownly provides agent supervision
Licensed branch manager supervision is included in Ownly's model. Remote supervision is allowed where the supervisor can still exercise proper direction and control. You do not need a traditional office, and supervision is not billed as a separate levy.
